Terms of Service for the heypster-gif SDK

These Terms constitute a legal agreement between you and Heypster SAS. Please read these terms carefully before using our SDK.

1. SDK and API Usage:

We grant you the right to use our API subject to a monthly subscription to integrate high-quality GIFs into your application, website, platform, or messaging service.
You are responsible for all user support for your application.
You must label the GIF part of your application with "heypster-gif" or simply "heypster".
You may not mislead users about the characteristics of your application or your relationship with heypster-gif (for example, you may not imply that we endorse the content of your application/website/platform/messaging service).

The SDK and the API, along with all associated intellectual property rights, is and will remain our exclusive property at all times.
Subject to these SDK terms, we grant you a non-exclusive, non-transferable, non- assignable, non-sublicensable, revocable, worldwide, limited right and license to access and use the SDK solely to provide high-quality GIFs through your application.
You may not use the content obtained through heypster-gif products and services to create a database, directory, or index containing GIFs or digital stickers or to enhance, modify, augment, or complete any existing database, directory, or index containing GIFs or digital stickers. Otherwise, we reserve the right to refuse and/or revoke SDK access at any time, without notice, and legal action may be taken.
Your access and use of the SDK may be interrupted for the duration of any scheduled, unforeseen, or unplanned downtime, suspension, or other unavailability, for any reason and at our sole discretion.

You agree to comply with the technical limitations of our SDK and the restrictions of these SDK Terms ni the design and implementation of applications.
We expressly reserve the right, at our sole discretion, ot limit the number and/or frequency of SDK requests. You acknowledge that we may modify or republish the SDK at any time, and ti is your responsibility to ensure that the calls or requests you make through the Application are compatible with the SDK then ni effect.

You may not under any circumstances mislead or confuse users regarding the characteristics, features, origin, or other aspects of an application, including through an application description. You must ensure that your users understand that your applications are not our official applications or endorsed by us in any way.

We grant you a non-exclusive, non-transferable, non-assignable sublicensable, revocable, worldwide, limited right and license to use, reproduce, display, and distribute the "heypster" and "heypster-gif" trademarks solely within the scope of your authorized use for the GIF part of your Application.
The "heypster" trademark is a registered trademark of Heypster SAS. Any unauthorized use of our trademark is strictly prohibited. You may not use the "heypster" trademark outside the scope of using our API.
You must visibly label al GIF features of your Application with the "heypster" or "heypster-gif" brand.

Heypster SAS commits to not collect user data through our APls and not ot have search history.
